(1) Land, buildings, equipment and structures related to electricity generation, transmission or distribution shall not be nationalized. However, the Government of Nepal may take over and develop land, buildings, equipment and structures related to hydropower generation, transmission or distribution of 1000 kilowatts or less for wide public use. Explanation: Widespread public use means use that benefits a larger population than the population currently benefiting from the use.
(2) According to the restrictive clause of sub-section (1), the Government of Nepal shall give compensation to the concerned person for the land, building, equipment and structure taken by the Government of Nepal as prescribed.
(3) The compensation given in accordance with sub-section (2) shall be determined on the basis of the current value of the land, buildings, equipment and structures taken by the Government of Nepal (deducting the damage and loss due to normal use).
